Terms of Use

1. Acceptance of terms

By accessing or using the EverTiles website and services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms form a binding legal agreement between you and EverTiles. Your continued use of the Service after any update to these Terms constitutes acceptance of the revised Terms.

2. Who we are

EverTiles is an AI-powered pet portrait service that transforms pet photos into stylized digital and physical art products. We operate as an online platform connecting users with AI image generation technology and third-party print-on-demand fulfillment partners.

3. Eligibility

You must be at least 18 years old to use the Service or make any purchase. By using the Service, you represent that you meet this requirement and have full legal capacity to enter into these Terms.

4. Your account

You may create an account to save portraits, view order history, and track shipments. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at the contact details in Section 18 if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, following reasonable notice where required by applicable law.

5. Pet photos — your content

When you upload a photo ("User Content"), you retain ownership of that photo. By uploading it, you grant EverTiles a limited, non-exclusive, worldwide, royalty-free license to store, process, and display the photo solely to generate your portraits and operate the Service.

You represent and warrant that you own the photo or have the right to use it, that it does not infringe any third-party rights, and that it contains no identifiable people without their consent.

We do not use your pet photos to train AI models or share them with third parties beyond what is necessary to deliver the Service. See our Privacy Policy for details.

6. AI-generated portraits — ownership

Upon successful payment, ownership of the purchased portrait image(s) transfers to you for personal, non-commercial use. Unpurchased portraits generated during a session remain the property of EverTiles and may be deleted after 30 days. Commercial use of purchased portraits requires our prior written consent.

7. AI output — expectations & limitations

By using the Service, you acknowledge and accept that:

• AI-generated results are inherently variable. The same photo and style may produce different outputs across sessions.
• Portraits are stylized artistic interpretations. EverTiles makes no guarantee of likeness, accuracy, or resemblance to your pet.
• Output quality is directly affected by the quality of the uploaded photo. Low-resolution, blurry, heavily filtered, or poorly lit photos will produce inferior results. This does not constitute a defect.
• Dissatisfaction with the artistic style or AI interpretation of a portrait — where the generation process completed normally — does not entitle you to a refund.
• We generate 6 portrait options per session so you can select your preferred result before purchasing.
• We recommend reviewing all generated options carefully before completing any purchase.

8. Products & pricing

We offer digital downloads (high-resolution, watermark-free) for a flat fee, and physical MIXPIX® tiles produced by our fulfillment partner. Tiered pricing applies to physical tiles — the per-tile cost decreases with larger orders. All prices are in USD. Shipping costs are shown separately at checkout.

EverTiles reserves the right to change prices at any time. Changes will not affect orders already confirmed.

9. Payments

Payments are processed by Lemon Squeezy, our third-party payment processor. By purchasing, you also agree to Lemon Squeezy's applicable terms. EverTiles does not store your full payment card details. All transactions are subject to authorization by your payment provider; EverTiles is not liable for payment failures caused by third parties.

10. Refunds & cancellations

Digital downloads — no refunds. Digital portrait files are delivered immediately upon purchase and are non-returnable by their nature. All sales of digital downloads are final and non-refundable. This applies regardless of dissatisfaction with the AI's stylistic interpretation, provided the file was successfully delivered.

Physical MIXPIX® tiles — limited remedies only. Because all physical prints are custom-made to order, we do not accept returns or offer refunds for change of mind. Remedies are available only in the following specific cases:

• Manufacturing defect or print damage: If tiles arrive with a clear manufacturing defect (e.g., misprinted, structurally damaged on arrival), contact us within 7 days of the delivery date with your order number and photographic evidence of the defect. We will assess the claim and, at our sole discretion, offer a replacement of the affected tiles or a partial credit. We do not offer cash refunds for physical orders except where required by mandatory law.
• Carrier damage in transit: If your order is visibly damaged due to shipping mishandling, retain all original packaging and contact us within 7 days of delivery with photos. We will file a claim with the carrier on your behalf. Resolution is subject to carrier liability terms and is not guaranteed.
• Non-delivery: If tracking confirms that your order has not moved for more than 45 days from the dispatch date, contact us. We will investigate with the carrier. If the carrier confirms loss, we will reprint and reship the order once. We do not offer cash refunds for lost shipments.
• Cancellations: Orders may be cancelled within 2 hours of placement, provided production has not yet commenced. After that window, cancellation is not possible as production begins promptly. To request a cancellation, contact us immediately using the details in Section 18.

Nothing in this section limits rights you may have under the Israeli Consumer Protection Law, 1981, or other applicable mandatory legislation that cannot be contractually waived.

11. Physical prints, fulfillment & shipping

Physical MIXPIX® tile orders are produced and shipped by MerchOne, an independent third-party print-on-demand fulfillment provider. EverTiles acts as a seller of the product; MerchOne acts as the producer and shipper.

Production and shipping timelines are estimates only. Any timelines or delivery windows displayed on our website or at checkout are indicative and not contractual commitments. EverTiles does not guarantee delivery by any specific date.

Carrier responsibility. Once an order has been dispatched and a tracking number issued, responsibility for the shipment passes to the carrier. EverTiles is not liable for carrier delays, misdelivery, customs clearance delays, or damage occurring after dispatch.

International orders may be subject to import duties, taxes, and customs clearance delays. These are the sole responsibility of the recipient. EverTiles has no control over customs processing timelines and will not issue refunds or replacements for delays caused by customs authorities.

Incorrect address. You are solely responsible for providing accurate and complete shipping information at checkout. EverTiles and MerchOne are not liable for non-delivery or misdelivery resulting from an incorrect or incomplete address. Reshipment due to address errors will be charged at full cost.

Tracking information will be made available through your "My Orders" page once your order has been dispatched. Tracking events are provided by MerchOne and third-party carriers; EverTiles does not control the accuracy or timeliness of tracking updates.

12. Prohibited conduct

When using the Service, you agree not to upload illegal or rights-infringing content; attempt to reverse-engineer, scrape, or automate access to the Service; circumvent payment, watermark removal, or access controls; misrepresent your identity; or use purchased portraits for commercial purposes without our written consent.

We reserve the right to suspend or terminate access and to cancel orders for violations of this section without refund.

13. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, EverTiles disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated portraits will meet any particular expectation of likeness or quality.

14. Limitation of liability

To the maximum extent permitted by applicable law, EverTiles and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to EverTiles for the specific order giving rise to the claim.

EverTiles is not liable for failures caused by events outside our reasonable control, including third-party service disruptions (MerchOne, Lemon Squeezy, carriers), internet outages, natural disasters, or governmental actions.

Nothing here limits our liability for death or personal injury caused by our negligence, fraud, or liability that cannot be excluded under mandatory applicable law.

15. Privacy & data

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. By using the Service, you consent to the processing of your personal data as described therein.

16. Changes to these terms

We may update these Terms at any time. Material changes will be communicated by updating the effective date and, where required by law, by more prominent notice. Continued use of the Service after updated Terms take effect constitutes acceptance.

17. Governing law & disputes

These Terms are governed by the laws of the State of Israel. Any dispute not resolved by good-faith negotiation within 30 days of written notice shall be submitted to the exclusive jurisdiction of the competent courts of Tel Aviv, Israel. Mandatory consumer rights under your local law are not affected.
